Professor Barnett påpekar att både John Roberts och Barrack Obama sa fel när den senare idag skulle sväras in som president. Detta är vad konstitutionen anger ska sägas:

I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.

På ett sätt kan det vara trösterikt att även så framgångsrika och smarta personer kan begå små misstag. Men eftersom rätt ed inte uttalades blir frågan: Är Obama verkligen president nu? Och vad skulle hända om en nyvald president på den sista frågan svarade: ”While I will certainly need help, I do not expect it from fictitious beings”? Skulle USA fördöma en ateistisk president, trots att konstitutionen uppenbarligen inte innehåller formuleringen ”So help me God”? (Ja, troligen.) Slutligen: Var inte Condoleeza Rice president för ett tag idag och därmed USA:s första svarta president?
